Appeal by the plaintiff, James M. Lalor, from a judgment of the Supreme Court in favor of the defendant, entered in the office of the clerk of the county of Hew York on the 13th day of July, 1908, upon the decision of the court rendered after a trial at the Hew York Special Term.

Ingraham, J.:
This was an action for the specific performance, of a contract for the sale of real property. The decree is of a somewhat rinnsnal form. It directs the defendant to tender a conveyance to the plaintiff. Upon the tender of such conveyance the plaintiff is required to pay to the defendant or to her attorney the sum of money required to be paid on the completion of the contract, and that if the plaintiff refuses to receive the said deed, the defendant shall file the same with the clerk of this court, and upon the filing of such conveyance the plaintiff shall pay to the defendant or…
