Rosabel Alice Wood Martin inherited fourteen acres of property located at Hightower and Simpson Roads in Atlanta, which had been purchased by her grandfather prior to the War Between the States. In the early 1960s, she deeded the property to her husband by warranty deed wherein title remained until his death in October, 1978. In his will, he devised this property to the Rosabel and James V. Martin Foundation which he established for charitable purposes. Mrs. Martin then filed this suit against the C & S National Bank as executors of Martin’s estate, claiming the…
