Appeal by the defendant from a judgment of the County Court, Suffolk County (Tisch, J.), rendered October 2, 1989, convicting him of attempted murder in the second degree and robbery in the first degree, upon a jury verdict, and imposing sentence.
Ordered that the judgment is affirmed.
The defendant contends that the court erred in refusing to preclude the trial testimony of certain witnesses who had testified at the first Grand Jury proceeding, for the reason that the minutes of their Grand Jury testimony had been lost.
