In this case one of the appellants, Leslie L. Walden1 (Walden), was injured during construction of a sewer *571in a public street in the District of Columbia where he was employed by the Department of Sanitary Engineering. He and his wife seek to hold the abutting property owners responsible for the injuries sustained. We shall affirm the judgment entered in favor of the defendants when a trial judge determined at the end of the plaintiffs’ case that the evidence adduced by the plaintiffs was legally insufficient to warrant submission of the case to the jury.
