(dissenting). I cannot concur in the opinion by which a writ of mandamus was issued to Justice Clark and myself compelling us to certify our disqualifications to sit in this cause.

In obedience to said writ I did, on the 4th day of February. 1927, so certify my disqualification to His Excel'ency, the Governor, as I was commanded to do.
