Proceeding pursuant to *823CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of respondent Commissioner of Environmental Conservation which, inter alia, imposed a civil penalty upon petitioner Michael Don Vito, Sr. for violating certain regulations of the Department of Environmental Conservation.
