Appeal by the plaintiff, Kate Treat Goodsell, from an order of the Supreme Court, made at the blew York Special Term and entered in the office of the clerk of the county of blew York on the 8th day of October, 1902, granting the defendant’s motion to extend the scope of an order of reference theretofore granted in the action upon the defendant’s previous application for a modification of the alimony allowed to the plaintiff by a decree of divorce.

Lattghlin, J.:

On the 21st day of August, 1899, a decree of divorce was duly granted herein in favor of the plaintiff, which required that the defendant pay her alimony at the rate of $2,700 per annum. The defendant, claiming a change in his financial circumstances, subsequently applied for a modification of the decree as to the amount of alimony, and upon such application the court, on the 30th day of April, 1900, ■ ordered a reference to take proof of the facts.
