This is an action of trespass brought by a servant to recover damages for personal injuries which he alleges he sustained by reason of the negligence of his master.
At the time the plaintiff received his injuries, he was in the # service of defendants, who were then engaged in constructing for the city of Philadelphia a portion of the subway for the tracks of the Philadelphia and Reading Railroad.
