—Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court at Special Term, entered in Albany County) to review a determination of the State Comptroller, which denied petitioner’s application for accidental disability retirement and ordinary disability retirement benefits. Frank H. Sorge was employed as a Deputy Sheriff for Monroe County from April 1, 1954 until November 18, 1962, at which time he resigned and withdrew all his contributions from the New York State Employees’ Retirement System.
