Appeal from District Court, Jefferson County. Action by B. F. Hughes against W. J. B. Adams and others. From a judgment for plaintiff, defendants appeal.

This is tbe second appeal in this case. Hughes v. Adams, 55 Tex. Civ. App. 197, 119 S. W. 135. On the first trial the court sustained several exceptions, which were in legal effect a general demurrer, to the petition. The main contention urged was that the contract sued on was void on its face, on the ground that it did not sufficiently describe the land, and that such description as was given in the contract could not he helped by the averments of the petition.
