CUDAHY, Circuit Judge.
The plaintiff appeals from an order dismissing his complaint for “failure to state a claim upon which relief can be granted,” Fed.R.Civ.P. 12(b)(6). The complaint alleges that the warden of the Pontiac Correctional Center failed to protect the plaintiff from an attack that occurred while the plaintiff was confined within Pontiac’s Condemned Unit, an enhanced security section for prisoners sentenced to death.
