MEMORANDUM OPINION AND ORDER
HAIGHT, District Judge:
The above-captioned action is before this Court as part of a larger diversity action brought by plaintiff, Leigh Company (“Leigh Co.”), a limited partnership based in Boston and formed under Massachusetts law, against several defendants in the United States District Court for the Central District of California. One of the named defendants in that action was the Bank of New York (the “Bank”), a New York corporation.
