KELLAM, District Judge.

Plaintiff obtained a judgment in the State Court against Daniel W. Evans, hereafter called Evans, for $32,000.00 and court costs, for personal injuries *231sustained in a collision between an automobile operated by her and belonging to her mother, and an automobile operated by Evans, belonging to Budget Rent-A-Car, hereafter called Budget. In the State action Budget, originally made a party defendant, was dismissed.
