Plaintiffs in this action challenge the refusal of the Department of Labor (“Labor”) to certify as eligible to apply for worker adjustment assistance the former employees of the Amstar Sugar Corporation’s Bunker Hill sugar refining plant in Charlestown, Massachusetts. Before it was closed in 1988 the plant refined raw sugar for sale to producers of various sugar-containing products. Plaintiffs challenged Labor’s prior final determination that the plaintiffs’ separation from employment was not attributable to increased imports into this country of raw or refined sugar…
