Appeal by the plaintiff, William B. Gottlieb, from a judgment of the' Supreme Court, in favor of the defendant, entered in the office of the clerk of ‘the county of New York on the 21st day of April, 1903, upon the verdict of a jury rendered by direction of the court after a trial at the New York Trial Term.

This is an action to recover an amount due the plaintiff from the defendant upon an account stated. The defense was payment of the money under garnishee process issued out of the Circuit Court of Cook county, 111., in an action brought by the Milwaukee Elevator Company against the plaintiff. The defendant in the *381action in the courts of Illinois was sued under the name of W. B. Gottleib. The defendant in this action introduced in evidence the judgment roll in the former action and proved payment of the account on which this action is based under the garnishee process issued…
