— Reversing.

The appellant and defendant below, Howard Tibbs, was indicted by the grand jury of Wolfe county, in which, he was charged with grand larceny committed by stealing two Jersey cows from their owner, William 0 ’Hare, of, the value of more than $20. At his trial he was convicted and punished by confinement in the penitentiary for one year — the minimum provided by statute. His motion for a new trial, which the court overruled, contained only three grounds for setting aside the verdict and judgment pronounced thereon, and which were and are: (1) Error…
