The suit is one brought under the Federal Employers’ Liability Act, 45 U.S.C.A. § 51 et seq., by the executrix oí Mike Lukon, to recover damages from The Pennsylvania Railroad Company by reason of alleged negligence which caused Lukon’s death. At the close of the evidence the defendant *328moved the court to direct a verdict in its favor and also requested binding instructions. Both of these motions were refused.
