On September 11,1989, a fire damaged the budding and contents of Mt. Calvary Baptist Church on Chicago’s south side. One week later, defendant Mount Calvary Baptist Church (“Mt. Calvary”) filed for bankruptcy in United States Bankruptcy Court for the Northern District of Illinois. In November 1989, plaintiff Church Mutual Insurance Company (“Church Mutual”) filed suit in the United States District Court for the Northern District of Illinois seeking a declaratory judgment that it was not liable to Mt.
