In April, 1879, the land in controversy being vacant public domain, one William Hutton settled thereon and made such improvements as entitled him to be classed as an actual settler under the Act of May 26,1873. Hutton remained upon the land until in the summer of 1881, when on account of the excessively dry weather he moved his family with his flock of sheep about eight miles, to obtain water, and never afterward returned thereto with his family, although a part of his furniture remained in the house until the summer or fall of 1882, and the forage for his stock which…
