In this case, the Department of Environmental Resources (“department”) issued an order to *152Crucible, Inc. (“Crucible”) to make certain changes in the latter’s coke oven operation at Midland, Pa. The order was, in form, effective immediately.

Crucible took an appeal to the board, and a week later petitioned for a supersedeas. The petition for supersedeas was based on the fact that, if the department’s order were ultimately held valid, Crucible would be subjected to potential civil penalties and criminal fines for the period between the issuance of the order and…
