The appellant was sued by the appellee for damages for a breach of a written warranty in the sale of a piano.
The appellee, appearing specially, has filed a motion for the dismissal of the appeal for want of jurisdiction. The appeal was taken in term time, the transcript on appeal being filed July 15, 1902. The act of March 12, 1901, concerning appeals, etc. (Acts 1901, p. 565 et seq., §1337a et seq. Burns 1901), provided in §6: “fío appeal shall hereafter be taken to the Supreme Court or to the Appellate Court in any civil case which is within the jurisdiction of a justice of the peace except…
