Appeal from a judgment of the Appellate Division of the Supreme Court in the first judicial department, entered April 17, 1918, modifying and affirming as modified a judgment entered upon the report of a referee.

The judgments of the courts below determine the respective rights of the parties in the stocks of the so-called Standard Oil subsidiaries distributed in 1911 and 1912 pursuant to the decision of the Federal Supreme Court. (Standard Oil Co. of N. J. v. United States, 221 U. S. 1.)

This action was brought by the substituted trustees under the will of Josiah Macy, Jr., deceased, of the trust thereby created for the benefit of the defendant Kate M. Ladd and remaindermen for instructions in regard to "the stock so distributed, and in regard to certain stock dividends and rights declared and issued…
