Much unnecessary labor by counsel has been put upon this case from the outset to the present time by failing to recognize and give effect to the terms of the plain contract whereby the mere use of the mill property was contributed by plaintiff as her share of the capital of the firm of J. S. Hart & Co., and confusing the simple questions governing the accounting between the members of the firm, and the questions governing the incidental settlement of the account between the lessor of the mill property and the lessee, with numerous questions governing the settlement of the estate of J. W. Hart…
