|TI respectfully dissent from the majority opinion affirming the judgment of the Office of Workers’ Compensation. I note at the outset, the immediate events surrounding Jimmie’s death were unwitnessed. The only person who knew what Jimmie was doing at the time of his death is dead. Thus, the parties in this case could only rely on circumstantial evidence, rather than direct evidence, to prove what Jimmie was doing at the time he was electrocuted.
