Appeal from an order of Supreme Court, Jefferson County (Gilbert, J.), entered September 6, 2002, which, inter alia, dismissed the petition against respondent David Lowry.
It is hereby ordered that the order so appealed from be and the same hereby is unanimously modified on the law by denying the cross motion in its entirety and reinstating the petition *1380against respondent David Lowry and as modified the order is affirmed without costs.
