—In an action to recover damages for personal injuries, the plaintiff appeals from a judgment of the Supreme Court, Kings County (Garry, J.), entered January 28, 1991, which, upon a ruling, made at the close of the plaintiff’s case granting the respondent judgment as a matter of law, is in favor of the respondent and against the plaintiff dismissing the complaint.
Ordered that the judgment is affirmed, with costs.
