MURRAY, Justice.

This is an appeal from a judgment in the district court of Angelina county against Texas & New Orleans Railroad Company, appellant, in favor of Mrs. Nellie Burden, appellee, for the death of her husband, E. P. Burden.

Mr. Burden was killed by a passenger train of the appellant at a grade crossing near Diboll while attempting to. walk across the main line track of appellant at a point opposite a store operated by Mr. Burden. The railroad tracks of the appellant at that point consisted of the main line and a siding on the east side of the main line. Both tracks ran approximately…
