This appeal is from a conviction of first degree murder. ORS 163.010(1). The defendant, Tina Lee Tremblay, was jointly indicted with her husband, Robert Antonio Tremblay, Mark Steven Barton, and Raymond David Pister, for billing G-ary Eugene DeVillez on July 16, 1969. They were tried separately.
