In an action, inter alia, to recover damages for breach of contract and for an accounting, the plaintiffs appeal from a judgment of the Supreme Court, New York County (Gammerman, J.), dated January 25, 2002, which, after a non-jury trial (Freedman, J.), and upon the granting of the defendants’ motion pursuant to CPLR 4401 for judgment as a matter of law, dismissed the complaint. By decision and order of the Appellate Division, First Department, dated May 29, 2002, this appeal was transferred to this Court for hearing and determination (see NY Const, art VI, § 4 [i]).
