This appeal was taken from the action of the Superior Court of Baltimore City in denying a motion of the appellant to have the case transferred from the jury docket to the non-jury docket. The appellee contends that the rule of Court relied on by the appellant -is Hot properly certified to this Court, and hence the presumption that the lower Court has properly construed its own rule should prevail. But as we understand it to be admitted that the rule, which is in the record, is a correct copy—indeed, both briefs contain it—we will construe it, notwithstanding the method by which it is…
