ELKINGTON, J.

— Defendant Veronica Bagwell appeals from a judgment based on a jury verdict finding her guilty of second degree murder.

There was little factual disagreement on the evidence which was properly placed before the jury.

Defendant’s husband was having an affair with another girl and he had commenced an action for dissolution of their marriage. On the evening of the day that she was served with summons defendant obtained a knife from the kitchen, went to the bedroom where her husband was lying, and stabbed him in the chest.
