Defendant appeals from a judgment entered against it in an action for malicious prosecution.

Plaintiff was indicted by a Grand Jury in St. Lawrence County for an alleged violation of section 940 of the Penal Law, which provides in substance that a person who secretes or disposes of personal property covered by a chattel mortgage, with intent to defraud the mortgagee or a purchaser thereof, is guilty of a misdemeanor.
