GURFEIN, District Judge:

This is a claim by a salvor, Lewis Raymond Nadie, for a maritime lien on account of his salvage operations in attempting to free from a strand in Honduras the vessel M/V TEQUILA (ex LINGLEE). 1 The claim is opposed by the holder of the foreign preferred ship mortgage, Empire Commercial Corporation (“Empire”), which obtained the mortgage four months after the alleged salvage by the claimant. It is agreed that if Nadie has a maritime lien it is superior to the valid maritime lien based on the mortgage. 46 U.S.C. § 953(a); 46 U.S.C. § 951. The question at issue is whether…
