This is an action in the nature of one for malicious prosecution and false arrest, brought by John Doherty, plaintiff below and appellant here, against George W. Patterson, county and prosecuting attorney of Albany county, M. C. Brown, a justice of the peace in said county and against the surety companies Which had furnished the official bonds of said Patterson and Brown.
