Tbe plaintiff in error was found guilty of tbe unlawful sale of liquor without a license, and bas brought bis case to this court. We are of opinion that tbe judgment of the lower court is sustained by tbe evidence.

Tbe case was tried by tbe Honorable James F. Baker, special judge, who was elected in tbe absence of tbe judge of tbe circuit court, in accordance with tbe provisions of Shannon’s Code, 5730-5732. Tbe clerk’s entry upon tbe minutes of tbe court shows that this election was regularly held, Mr. Baker chosen by tbe members of tbe bar present, and tbe…
