In a matrimonial action in which the parties were divorced by judgment entered January 5, 2004, the defendant appeals, as limited by his brief, from so much of an order of the Supreme Court, Suffolk County (McNulty, J.), dated December 21, 2005, as, without a hearing, denied that branch of his motion which was for a downward modification of his maintenance obligation pursuant to a stipulation of settlement, which was incorporated but not merged into the divorce judgment, and granted that branch of the plaintiffs cross motion which was for an award of an attorney’s fee.
