MEMORANDUM OPINION AND ORDER

WILLIAM A. HILL, Bankruptcy Judge.

The instant adversary action was commenced by Sargent County Bank (BANK) by Complaint filed November 26, 1885, alleging a right to indemnification from the Debtor and a determination of non-dis-chargeability under section 523(a)(2) to the extent of such indemnification. Answering, the Debtor, Merlyn Yagow, denies responsibility for the damages allegedly sustained and additionally argues that no damages have actually been sustained.
