W. E. Bier, late sheriff, administrator of George L. Smith, deceased, filed his bill in the circuit court of Pleasants county, in which he alleged, that his intestate, George L. Smith, by verbal agreement had purchased two certain tracts of land of the defendant, John E. Smith, and that he was in peaceable possession of said tracts of land at the time of his death in 1875; that after the death of said George L. Smith the said John E.
