MANFORD, Presiding Judge.

This is a direct appeal from a jury conviction for violation of § 564.011, RSMo 1978, the class D felony of attempted stealing. The judgment is affirmed.

*773Respondent correctly points out that appellant filed an untimely motion for new trial. The motion was filed 39 days after the verdict. The record reveals that neither appellant nor the trial court complied with Rule 29.11. The verdict was rendered January 31,1980. The court designated February 8, 1980 as the date for a persistent offender hearing and stated that the time for filing the motion for new trial would run…
