This matter is before the Court on interlocutory appeal by defendant Township of Scotch Plains (“Township” or “defendant”) of the August 6, 1998 Memorandum Opinion and August 28, 1998 Order, denying in part defendant’s motion to dismiss, and the January 7, 1999 Order denying defendant’s motion for reconsideration entered by the Honorable Stephen A.
