The plaintiff’s alleged claim grows out of certain stock transactions handled by the defendants as his brokers. They are a limited partnership, organized under the laws of the State of New York, having their principal office in New York City, with branches in Boston and Chicago. Previous to the opening of his account with them the plaintiff had a margin account with Nickerson and Company, a stock-brokerage house in Boston.
