After the death of Melvin Coonce (Coonce), Coonce’s surviving spouse and sons (hereinafter referred to collectively as Plaintiffs) filed a wrongful death suit against Richard Simons (Defendant). The petition alleged that Defendant’s negligent nursing care caused or contributed to cause Coonce’s death. Defendant moved for summary judgment on the ground that Plaintiffs had not produced, and would not be able to produce, evidence sufficient to allow the trier of fact to find that Defendant’s acts or omissions caused or contributed to cause Coonce’s death.…
