Plaintiff brought this action to obtain a refund of special assessments paid under protest. Plaintiff’s land was in a special assessment district within the city of South Gate, established under the Acquisition and Improvement Act (Stats. 1925, p. 849; Deering’s Gen. Laws, 1931, Act 3276(a))* for the improvement of Wright Road, a highway of general county use. The defendant city undertook the proceedings necessary to form the district and issued bonds totalling $43,400 to cover the cost of the improvement.
