—The statement of the nature and result of the suit is stated in the appellant’s brief as follows;
This cause involves the contest of a will and codicil thereto, arising upon application to probate. In August, 1903, the appellant filed in the County Court of Ellis County his application for the probate of the will and codicil thereto of Mrs. M. E. Goodloe, deceased, his mother, who died on July 35, 1903, leaving a will which designated appellant as the executor. The probate of the will and codicil wap contested by J. H.
