In this case, the petitioners, Peabody Coal Company (“Peabody”) and Old Republic Insurance Company (“Old Republic”), appeal a decision of the Benefits Review Board of the Department of Labor (“the Board”), affirming an administrative law judge’s modification of a benefits award under the Black Lung Benefits Act, 30 U.S.C. §§ 901-945 (“The Act”), in favor of one of the respondents, Ricky D.
