This is a bill to foreclose a mortgage on real property, but the important issue grows out of a charge of fraud in the answer and counter-claim.

On May 14th, 1923, the defendants executed a purchase-money mortgage in the sum of $1,600, and delivered the same to the complainants, the mortgagees. On November 14th, 1923, the first installment of interest fell due and was not paid, but within the thirty days of grace provided in the mortgage the defendants caused a writ of attachment to issue out of the circuit court of Bergen county against the lands and tenements, c., of the complainants.
