Laug-hlin and Hatch, JJ., dissented. Appeal by the defendant, the Siegel-Oooper Company, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Yew York on the 26th day of April, 1902, upon the verdict of a jury for $7,500, and also from an order entered in said clerk’s office on the 10th day of April, 1902, denying the defendant’s motion for a new trial made upon the minutes.

Ingraham, J.:

The action was brought to recover the damages caused by the death of the plaintiff’s intestate. The complaint alleges that the defendant was in the possession, management and control of a building on the east side of Sixth avenue, between Eighteenth and Yineteenth streets, in the city of Yew York ; that on or about July 23, 1901, the defendant operated in and in connection with said premises a certain elevator for the purpose of conveying merchandise from the lower floor of its premises to the floors above; that the said elevator, on the 23d day of July, 1901, and for a long time…
