HARDBERGER, Chief Justice.
Appellant, Jeanette Guardia (“Guardia”), appeals the trial court’s summary judgment dismissing her case against appellee, John Kontos, as Administrator of the Estate of Gregory L. Kontos, Deceased (“Kontos”). In five points of error, Guardia contends the trial court erred because: (1) it failed to correctly interpret and apply limitations tolling provisions; (2) the evidence is legally and factually insufficient to support the affirmative defense of limitations; and (8) the issue of due diligence in serving Kontos was not relevant.
