The appellant, William Dolan, was indicted, tried, and convicted in the Criminal Court of Baltimore City, for hav ing violated the provisions of section 247 of article 27 of the Code of Public General Laws of Maryland, which section is as follows:

“It shall not be lawful for any person * * * to bet, wage or gamble in any manner, or by any means, or to make or sell a book or pool on the result of any * * * running race of horses * * * or to establish, keep, rent, use or occupy or knowingly suffer to be used, kept or rented or occupied, any house, building, vessel, grounds or place or portion of…
