In Armstrong v. Grimes (70 Misc 2d 549) this court, faced with a Texas decree of custody and the question of modification thereof, held that, absent jurisdiction over custody either by referral from a court of competent jurisdiction or directly conferred by statute, this court’s power to modify an out-of-State custody decree would derive strictly from section 654 of the Family Court Act and would of necessity depend on that State’s power to modify its own decree.
